New York State law requires physicians to tell their patients why they should not take an HIV antibody test, including warning patients about privacy concerns. The regulations were developed in the 1980s when HIV stigma was high, says Thomas Frieden, New York City's health commissioner, who is working to do away with several outdated state testing rules.
